Terms and Conditions

1. The “Organiser” is Enable, a company incorporated in England and Wales company number 09487276, and registered with the Charity Commission (no. 1172345) and with registered offices at Battersea Park Offices, Battersea Park, London SW11 4NJ. 

2. These terms and conditions shall relate to Battersea Park Comedy Festival (the “Event”). 

Tickets 

3. By purchasing or accepting a free ticket and/or attending the Event using a ticket (a “Ticket”), the Ticket holder agrees to be bound by the terms and conditions set out herein. 

 

4.Any promotional offers are for ‘Standard’ tickets to the event. Promotional offers are at the Organiser’s discretion. 

 

5. A valid Ticket entitles the holder to attend the Event on the relevant date and timed session selected, as stated on the Ticket. Please note all Comedy Shows are strictly 16+. There is no admittance to the event for any child under 18 years without an accompanying adult at any time on June the 5th, 6th or 7th.  The Organisers have the right to refuse entry to late arrivals and no refunds for late arrival shall be granted. Any attendees under the age of 18 must be in the presence of a guardian aged 18 or over and must hold a valid ticket at all times.

6. All attendees must present a valid ticket to enter the event. For all Comedy Shows, the minimum age for attendance is 16 years old. For all Family Shows, all attendees whether adult or child must present a valid ticket, with only babes in arms permitted into the event without a ticket.  

 

7. Tickets shall not be resold, exchanged, or transferred. To do so, or to alter or deface any Ticket, will render it void.

8. Tickets can be printed or displayed on a smart phone. 

 

9. It is the Ticket holder’s responsibility to check the date and venue of their Ticket, as mistakes cannot always be rectified. The Organiser shall not be responsible for any lost or stolen Tickets. 

 

10. Tickets shall not be used as prizes in competitions without the prior written consent of the Organiser. 

 

11. Ticket holders who are eligible are entitled to a free Essential Companion Ticket at the Organisers’s discretion. Please see the Accessibility section of our website on how to apply. The Organiser will ask for proof of eligibility which could be provided with for example your DLA/PIP documentation, your Attendance Allowance documentation, The Access Card, blue badge guide or other proof of eligibility that the Organiser’s deem sufficient at their discretion. The Organiser reserves the right to cancel an Essential Companion Ticket if they suspect the Ticket has been claimed fraudulently. The availability of Essential Companion Tickets are subject to the availability of desired show at the point of the processing of the application.

12. At time of writing can only be purchased in advance, online through our ticket agent See Tickets. 

 

13. Tickets are non-refundable and non-transferrable. 

 

14. No access will be granted into Battersea Park Comedy Festival without a ticket.

15. Please bring proof of age identification as a requirement of entrance - Security's decision on entry will be final. 

 

16. Bag searches are a condition of entry and Security's decision is final. There are no lockers or cloakrooms available onsite.

17. Tickets can be printed or displayed on a smart phone. 

 

Refunds & Insurance  

18. Optional TicketPlan ticket cover insurance is provided by our third-party ticketing partner, See Tickets, and is subject to their specific terms, conditions, and policy wordings. Any contract for such insurance is held solely between the purchaser, TicketPlan and SEE Tickets. The Organisers assume no liability for the scope of the indemnity provided and maintain no discretionary authority over the adjudication of claims or the determination of coverage inclusions and exclusions. 

 

19. No refund shall be made if the Ticket holder is late, refused entry, evicted from the Event, unable to attend, or has purchased an incorrect ticket. 

20. Tickets are sold subject to the Organiser’s right to alter or vary the programme due to events or circumstances beyond their control without being obliged to refund monies or exchange Tickets. The appearance of any artist is not guaranteed and is subject to change without notice. 

 

21. Should the Event be postponed, a Ticket holder may be refunded if they are no longer able to attend the Event on a new date, however no additional expenditure incurred by the Ticket holder shall be refunded to the Ticket holder. Booking fees will not be refunded. 

 

22. Should the Event be cancelled by the Organiser, the Ticket holder may be entitled to a full refund of the Ticket price, but no refund shall be given in respect of any booking fees or any other expenditure whatsoever. Ticket refunds may be claimed for up to 30 days after the cancelled Event.  If the Event is cancelled due to Force Majeure, the Organiser will use reasonable endeavours to reschedule the Event. If rescheduling is not possible, Ticket holders will be entitled to a refund of the face value of the Ticket. Booking fees and any additional expenditure will not be refunded. 

 

23. For the purposes of these Terms and Conditions, “Force Majeure” means any cause beyond the Organiser’s control including, without limitation, an act of God, war, insurrection, riot, civil disturbances, acts of terrorism (or the threat thereof), fire, explosion, flood, royal mourning, national mourning, theft of essential equipment, malicious damage, strike, lock out, storm, third party injunction, national defence requirements and/or acts of national or local governments. The Organiser shall not be liable for failure to perform any obligation under these Terms and Conditions to the extent that the failure is caused by Force Majeure. 

 

24. Occasionally, inclement weather can disrupt an open-air event. Any decision to cancel the Event shall be taken by the Organiser. If the Event is curtailed after it has commenced, the Organiser shall not be liable to provide a refund where a substantial proportion of the Event has taken place. In other circumstances, the Organiser may, at its discretion, offer a partial refund. 

 

25. On entry, the Ticket holder agrees to accept and abide by any Event rules of the Organiser and any other regulations provided on entry to the Event. 

 

Alcohol 

26. The Organiser operates the ‘Challenge 25’ policy with regards to the purchase of alcohol. 

 

27. Any breach of the Terms and Conditions shall render the Ticket void and result in refusal of entry to the Event, or ejection from the Event. The Organiser reserves the right to conduct security searches to ensure the safety of visitors and refuse admission to any Ticket holder who is deemed to be a risk to the safety of visitors. The Organiser shall be entitled to remove anyone from the Event who is under the influence of drugs or alcohol or who, in the reasonable opinion of the Organiser, is conducting themselves in a manner unconducive to their continued attendance at the Event. Any Ticket holder removed from the Event shall not be readmitted. Re-entry to the Event shall only be permitted at the Organiser’s entire discretion. 

Conditions of Entry 

28. Searches: Bags brought into the event will be subject to search and personal searches at the discretion of security are both a condition of entry.   Bag searches are a condition of entry and Security's decision is final.  

 

29. Bag sizes: For the safety and enjoyment of others, customers are encouraged to bring only small bags where possible, i.e. small day rucksack or small bag measuring no more than 460mm x 330mm x 200mm. Any larger bags brought into the event will be subject to an enhanced search, including prams and buggies. Security reserve the right to refuse entry to those with unnecessarily large bags, rucksacks or luggage.   

 

30. Restricted items: the following items will not be permitted within the event:  

  • Dogs, except for Assistance Dogs UK (ADUK) registered dogs on presentation of an ADUK ID Book   

  • Food & drink: except for refillable water bottles, snacks, kids food or medically required food 

  • Glassware 

  • Parasols, gazebos, BBQs or picnic furniture, except for small camping chairs 

  • Fireworks, sparklers, sky lanterns or kites   

  • Bicycles  (bicycle parking will be provided outside the main entrance at owner’s own risk) 

  • Professional video, sound or camera equipment   

  • Balloons  

  • Flags  

  • Weapons, drugs or controlled substances 

 

31. Right of admission in all instances is at the full the discretion of security and / or the organisers.    

 

32. All sound and moving or still picture rights including, without limitation, on the internet, vest exclusively with the Organiser and any material filmed or recorded at the Event shall only be used for the personal, non-profit making enjoyment of amateurs. By entering the Event, Ticket holders consent to being photographed, filmed, or recorded as visitors attending the Event, and for their likeness, mannerisms and/or voice to be included in any content from such filming, photographs and/or recording (and edited) without compensation and/or credit, which content may be communicated and/or exploited in any and all media worldwide in all perpetuity. 

 

33. The Organiser, its contractors or agents, shall not be liable for any loss, injury or damage howsoever caused to the bearer of a Ticket, save for death or personal injury caused by the negligence of the Organiser, its contractors or agents or any other liabilities that cannot be excluded by law. 

 

34. Please note that prolonged exposure to loud noise may cause damage to hearing. Please be aware that strobe lighting may be used during certain activities during the Event. 

 

Data Protection 

35. The Organiser's data protection, data usage, privacy and cookie policy can be found at www.enablelc.org/privacy-cookies 

 

36. There are CCTV cameras within the Event and Battersea Park. Parks and Events Police and security will be present at the Event and will be equipped with body worn cameras.  

 

Severability and Variation 

37. The Organiser reserves the right to amend these Terms and Conditions from time to time when deemed reasonable and necessary to do so. Ticket holders are responsible for checking the Terms and Conditions that apply to the Event. The Organiser shall make all reasonable endeavours to put an alert on the Event website www.batterseaparkcomedyfestival.com if the Terms and Conditions have been amended. Any amendments will not materially affect the rights of Ticket holders who have already purchased Tickets. 

 

38. If any part of this agreement is declared unenforceable or invalid, the remainder of the Terms and Conditions shall continue to be valid and enforceable. 

 

39. These Terms and Conditions shall be governed by English law and those bound by them hereby submit to the exclusive jurisdiction of the English courts in connection herewith. Nothing in these Terms affects the consumer’s statutory rights.
